Terms of Service

These terms cover your use of Frozen Fund (the "Service"), a direct-mail marketing tool operated in Australia by Stock Marketed ("we", "us"). By creating an account or paying for a campaign, you agree to them.

1. What the Service does

Frozen Fund uses public government building-energy data and other public data to help HVAC, air-conditioning and refrigeration businesses find and post personalised mail to commercial buildings and homes worth targeting. You choose your area and design, review each piece, pay, and we arrange the printing and posting through our mail provider.

2. Your account

You must give accurate business details and keep your login secure. You are responsible for activity under your account. You must be a genuine, lawfully operating business and use the Service only for your own legitimate marketing.

3. No guarantee of results

We help you reach well-targeted prospects, but we do not guarantee leads, responses, sales or any particular outcome. Savings figures and ratings shown on mail are illustrative estimates based on public data, not promises, and are confirmed only by a site assessment.

4. Pricing and payment

Prices are shown in Australian dollars per piece before you pay and cover print, postage and data. Payment is taken securely through Stripe. You only pay for the pieces you approve and send. We may change pricing for future campaigns.

5. Approval, printing and posting

Nothing is printed or posted until you approve it and pay. Once paid, approved pieces are sent to our print-and-mail provider and queued for posting. Delivery times depend on Australia Post and are outside our control.

6. Refunds and cancellation

Because your mail is custom-printed and posted, a real cost is incurred the moment a piece is sent to print. So:

• Before a campaign is paid, you can cancel it any time at no charge.
• Once paid, pieces are sent to print quickly and generally cannot be refunded.
• If something goes wrong on our side (for example a piece is not sent, or is printed with a clear error we caused), contact us and we will refund or reprint that piece. Nothing here limits your rights under the Australian Consumer Law.

7. Acceptable use

You must not use the Service to send misleading, unlawful, offensive or deceptive mail, to impersonate others, or to breach any law. The business name, contact details and claims you provide for your mail must be accurate and ones you are entitled to use. We may pause or close accounts that misuse the Service.

8. Data

Building and energy ratings come from the public NABERS / Commercial Building Disclosure register (licensed CC BY 3.0 AU) and other public sources. How we handle your information is set out in our Privacy Policy. Mail is addressed to a role or business, not a named individual.

9. Availability and liability

The Service is provided "as is". We work to keep it running but do not promise it will always be available or error-free. To the extent the law allows, our total liability for any claim connected to the Service is limited to the fees you paid us for the campaign the claim relates to. We are not liable for indirect or consequential loss.

10. Changes

We may update the Service and these terms. If we make a material change we will note it here with a new date. Continuing to use the Service means you accept the updated terms.

11. Governing law

These terms are governed by the laws of New South Wales, Australia.
